Terms of Service

1. Acceptance of Terms

By accessing or using Appixio Hire ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms apply to all visitors, users, and others who access the Service.

2. Description of Service

Appixio Hire is an AI-powered interview platform that enables organizations to create, conduct, and evaluate candidate interviews. The Service includes automated scoring, voice and text interviews, interview integrity checks, reporting, and related features as described on our website.

3. Account Registration

• You must provide accurate, complete, and current information when creating an account.
• You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
• You must notify us immediately of any unauthorized use of your account at hello@appixio.com.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscription and Payment

4.1 Free Trial

New users may be offered a 14-day free trial. Trial usage is limited to the features specified in the Free Trial plan. At the end of the trial period, your account will remain active but with limited functionality unless you upgrade to a paid plan.

4.2 Paid Plans

• Subscription fees are billed in advance on a monthly or annual basis, as selected.
• Annual plans are discounted by 20% compared to monthly billing.
• All fees are in USD. Prices are subject to change with 30 days' notice.
• We accept major credit cards and other payment methods as made available on the platform.

4.3 Cancellation and Refunds

• You may cancel your subscription at any time from your account settings.
• Cancellation takes effect at the end of the current billing period — no partial-month refunds.
• Annual subscriptions: you may cancel within 14 days of purchase for a full refund. After 14 days, no refund is provided for the unused portion.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or to discriminate against candidates based on protected characteristics
• Attempt to reverse-engineer, decompile, or extract the AI models or proprietary algorithms underlying the Service
• Share your account credentials with unauthorized third parties
• Use automated tools (bots, scrapers) to access the Service without our written consent
• Interfere with or disrupt the Service's integrity or performance
• Upload content that is malicious, defamatory, or infringes on intellectual property rights

6. Candidate Data and Privacy

• You are responsible for obtaining proper consent from candidates before collecting their data through the Service.
• You must comply with all applicable data protection laws (GDPR, PIPEDA, CCPA, etc.) when processing candidate information.
• Candidate voice recordings are transcribed in real-time and immediately discarded. Only text transcripts are retained.
• You retain ownership of all candidate data you upload. Appixio processes it on your behalf as a data processor.

7. Intellectual Property

• You retain ownership of all content you upload, including job descriptions, interview frameworks, and candidate data.
• Appixio retains ownership of the Service, its AI models, algorithms, and platform code.
• AI-generated interview questions, scoring rubrics, and evaluation reports are provided for your use and are considered derived from your input data.
• You may not use Appixio branding, logos, or trademarks without our written permission.

8. Service Availability

We strive to provide 99.9% uptime but do not guarantee uninterrupted service. Scheduled maintenance windows will be communicated in advance. We are not liable for downtime caused by circumstances beyond our control (force majeure, third-party outages, etc.).

9. Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided "as is" without warranties of any kind, express or implied.
• Appixio shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
• Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Appixio, its officers, directors, and employees from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

11. Termination

Either party may terminate this agreement at any time. Upon termination:

• Your access to the Service will cease at the end of the current billing period.
• We will retain your data for 30 days to allow export, after which it will be permanently deleted.
• Provisions that by their nature should survive (IP, liability, indemnification) will remain in effect.

12. Governing Law

These Terms are governed by the laws of Canada and the Province of Ontario, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Ontario, Canada.

13. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or platform notice at least 30 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
